Welcome to Valismo! The terms "we", "us" and "our" refer to Valismo. Valismo operates this shop on the Shopify platform. The following Terms and Conditions describe your rights and obligations when using our services. By visiting our website or purchasing a product, you agree to be bound by these Terms and Conditions.
SECTION 1 – CONTRACTING PARTY AND MINIMUM AGE
The contracting party for all orders is Valismo, represented by Linus Böhle. By agreeing to these Terms and Conditions, you represent that you are at least the age of majority in your country of residence or that you have the permission of your legal guardians to use this website.
SECTION 2 – PRODUCTS AND REPRESENTATION
We make every effort to display the colors and images of our products as accurately as possible. However, as color display depends on your monitor, we cannot guarantee that the representation will exactly match the physical product. Product descriptions are subject to change at any time.
SECTION 3 – CONCLUSION OF CONTRACT (ORDERS)
The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalog. By clicking the "Buy now" (or "Zahlungspflichtig bestellen") button, you place a binding order for the goods contained in the shopping cart. Confirmation of receipt of the order is sent via an automated email immediately after sending. The purchase contract is only concluded when we accept your order by a separate declaration of acceptance or by shipping the goods.
SECTION 4 – PRICES AND PAYMENT (SMALL BUSINESS STATUS)
The prices at the time of the order shall apply. Special Note: All prices stated are total prices. Due to our status as a small business according to Section 19 UStG (German VAT Act), we do not charge VAT and therefore do not display it. Any additional shipping costs will be clearly indicated during the checkout process.
SECTION 5 – SHIPPING AND DELIVERY
We deliver within Germany and the EU. Delivery times are estimates unless a fixed delivery date has been expressly promised. For consumers, the risk of accidental loss of the goods passes to the customer upon delivery of the goods.
SECTION 6 – RIGHT OF WITHDRAWAL
Consumers are entitled to a statutory right of withdrawal. For details, please refer to our separate Cancellation Policy, which can be found at: https://valismo.de/policies/refund-policy.
SECTION 7 – WARRANTY AND LIABILITY
Statutory warranty rights apply. We are liable without limitation for damages resulting from injury to life, body, or health. In the event of a breach of essential contractual obligations (cardinal obligations), we are also liable for slight negligence, but limited to the typical, foreseeable damage. Otherwise, liability is excluded.
SECTION 8 – INTELLECTUAL PROPERTY
The content of this website (text, images, graphics, logos) is protected by copyright. Any use, reproduction, or distribution without our express written consent is prohibited.
SECTION 9 – EXTERNAL LINKS AND THIRD-PARTY PROVIDERS
Our shop uses the Shopify infrastructure. We assume no liability for the content of external third-party websites linked to our site.

SECTION 11 – DISPUTE RESOLUTION
The EU Commission provides a platform for Online Dispute Resolution (ODR): https://ec.europa.eu/consumers/odr/. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
SECTION 12 – GOVERNING LAW
The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer and have your habitual residence abroad, mandatory provisions of your country of residence remain unaffected by this choice of law.
SECTION 13 – SEVERABILITY CLAUSE
Should any provision of these Terms and Conditions be or become invalid, the remainder of the contract shall remain in effect. The invalid provision shall be replaced by the relevant statutory regulations.
